1. Introduction
Ascension Foundation and all its affiliated entities and subsidiaries (collectively the "Organization" or "we" or "our" or "us") respect your privacy and are committed to protecting it by complying with this privacy policy (our "Policy").

 

Our Policy describes:

  1. how we use, collect, hold, and disclose the personal information of our clients, suppliers, subcontractors, employees, job applicants, and users of our website ("you");

  2. our policies and practices governing the management of personal information, particularly regarding the applicable framework for the retention and destruction of such information, the roles and responsibilities of our staff throughout the information lifecycle, and our process for handling complaints concerning its protection; and

  3. the types of information we may collect from you or that you may provide when you visit the website www.fondationascension.ca and its subdomains (our "website").
     

We will only use your personal information in accordance with our Policy, unless otherwise required by applicable law.


2. Personal Information
The term “personal information” refers to any information about an individual that allows them to be identified, directly or indirectly. Please note that our Policy generally does not apply to the collection and confidentiality of information related to a person’s business role, such as their name, title or function, and the address, email address, and phone number associated with their workplace, but we always handle such information in strict compliance with applicable law. During your relationship with the Organization, you may be asked to provide certain personal information about yourself and/or about other individuals (such as family members or employees).


3. Purposes for Which We Collect Personal Information
The Organization uses, collects, holds, and discloses personal information only for the purposes identified at the time of collection, or as otherwise permitted or required by applicable law, including the following purposes:

  1. to collect donations and, when possible, issue official donation receipts;

  2. to comply with our professional obligations, including rules concerning client identification and identity verification;

  3. to establish and manage relationships with partners and suppliers, including assessing whether or not to enter into a relationship;

  4. to respond to information requests submitted through the website and provide appropriate follow-up;

  5. to send updates about our operations, our athletes, and any relevant information from Organizations within the same group;

  6. for administrative, management, and operational purposes, such as issuing invoices, managing accounts, sales, collecting and processing payments; and

  7. for any other purpose to which you have consented.
     

4. Information on Employees and Applicants
As part of its role as an employer, the Organization collects, uses, and discloses personal information. For our employees, this collection is essential to managing employment relationships. For applicants applying to us, their information is collected and used to assess their suitability for available positions, which may involve information obtained from third parties for background or reference checks. If a candidate is not selected, their information is retained for a reasonable period for future opportunities, unless a deletion request is made. Additionally, we retain certain personal information about former employees, including their name and contact details, for potential professional or regulatory requirements.
 

5. Limitation
The Organization aims to limit the amount of personal information it collects to what is necessary and appropriate for the identified purposes. We will not use or disclose your personal information for purposes other than those for which it was collected, unless you consent or applicable laws permit or require it.
 

6. Consent
We use, hold, and disclose personal information only for the purposes for which it was collected, unless the individual concerned gives consent. If personal information about a third party is provided to us, the person providing that information must confirm that they have obtained the necessary consent from that third party, or are otherwise authorized to allow us to collect, use, hold, and disclose that information in accordance with our Policy. When it comes to sensitive personal information, express consent from the individual concerned is required.

7. Withdrawal of Consent
You may modify or withdraw your consent to the use, holding, and disclosure of your personal information, or refuse certain aspects, subject to legal and contractual restrictions in accordance with applicable laws. To modify or withdraw your consent, please contact our Privacy Officer (identified below).

8. Information We May Collect
We collect and use several types of information from and about you, including:

  1. personal contact information such as name, physical address, email address, and telephone number;

  2. for job applicants to the Organization, employment history and curriculum vitae;

  3. biographical information such as job title and employer name;

  4. personal information you provide in order to make a donation, such as a credit card number, its expiration date, and security code;

  5. website usage information and other technical data, such as details of visits to our website, your interaction with our advertising and online content, or information collected through cookies and other tracking technologies; and

  6. any other personal information provided by you.
     

9. How We Collect Personal Information About You
We use various methods to collect your personal information, including through:

  1. direct interactions with you when you provide it to us, for example by filling out forms or corresponding with us by phone, by email, when you sign up to receive our newsletters, or otherwise (if we have sent you a promotional email such as a newsletter, you may unsubscribe by clicking on the unsubscribe link we included in the email or by following any other instructions included in the email);

  2. automated technologies or interactions, when you browse our website. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies;

  3. third parties you have authorized to provide it to us; and

  4. publicly accessible sources

  1. to collect donations and, when possible, issue official donation receipts;

  2. in the context of job applicants, to contact the candidate and to assess whether we will proceed with hiring;

  3. in the context of partner businesses, to contact the business and to assess whether a partnership can be established;

  4. in the context of individuals, to contact the individual and to assess whether a business relationship can be established;

  5. to assess whether we may wish to remain in contact with you, if applicable;

  6. to respond to information requests or inquiries from visitors to our website;

  7. to facilitate the use of our website and to ensure that the content of our website is presented in the most effective manner for you and your device;

  8. for marketing and business development purposes – to provide information on new services, legal updates, newsletters when a person has opted to receive them. You may request that this service be discontinued at any time; and

  9. to fulfill our legal, regulatory, or risk management obligations – to comply with our legal obligations.
     

12. Disclosure of Your Personal Information
We may disclose personal information that we collect or that you provide, as described in our policy:

  1. to third parties in order to collect donations and, when possible, issue official donation receipts, to service providers and other third parties we use to support the delivery of our services (such as administrative service providers) and who are contractually bound to maintain the confidentiality of personal information, to use it only for the purposes for which we disclose it to them, and to process personal information according to the same standards set out in our policy;

  2. to fulfill the purpose for which you provided the personal information;

  3. for any other purpose that we disclosed when you provided the personal information;

  4. with your consent; and

  5. to comply with a court order, a law, or a legal process, including to respond to a request from a government or regulatory body, in accordance with applicable law.
     

The Organization does not sell or trade for monetary consideration any personal information it holds.
 

13. Third-Party Service Providers
To the extent that the Organization uses third-party service providers to store, manage, or process personal information on its behalf (for example, data storage and processing services, cloud computing services, fundraising platforms), we use contractual and other means to provide a comparable level of protection while personal information is stored, managed, or processed by these service providers.

Our service providers have entered into contractual agreements with us to protect your personal information from any unauthorized access, collection, use, or disclosure.
 

14. Disclosure Outside Québec or Canada
When personal information is located outside Canada, it may be accessible by foreign governments, courts, and other governmental authorities, if required by law or a court order. We disclose or transfer personal information outside Canada only in compliance with applicable Canadian laws and for lawful purposes.

When we disclose personal information outside Québec, and sometimes outside Canada, we do so only for the purpose of developing our operations.

Before disclosing personal information outside Québec, we conduct a privacy impact assessment in accordance with applicable Québec law. This assessment takes into account: (i) the sensitivity of the information; (ii) the purpose for which it is to be used; (iii) the protection measures, including contractual ones, that the information would benefit from; and (iv) the legal framework applicable in the state where the information would be disclosed, including the generally recognized principles of personal information protection applicable there. Personal information is disclosed only if the assessment shows that it would benefit from adequate protection. If you would like more information about the service providers we use to whom personal information is disclosed outside Québec, please contact our Privacy Officer (identified below). We confirm that we may disclose, in strict compliance with our policy, your personal information outside Québec or Canada to third parties we engage to provide services involving the use, disclosure, or retention of your personal information on our behalf. You consent to such disclosures, uses, or retentions.
 

15. Territorial Restrictions and Compliance with Local Laws
The Organization is established and operates in accordance with the laws of the Province of Québec, Canada. Privacy laws may differ depending on your jurisdiction of residence. If you reside or are located outside the Province of Québec, you are responsible for ensuring that the transmission of your personal information to the Organization is permitted by the local or national laws applicable to you. By transmitting your personal information to the Organization, you acknowledge and accept that this information will be subject to the laws of the Province of Québec, Canada, and that the Organization cannot be held responsible for non-compliance with privacy laws in force in your jurisdiction.
 

16. Personal Information Governance Policies and IT Security
Our commitment to your privacy. We take the security and responsible management of your personal information very seriously. Our governance policies concerning personal information have been formally approved by our Privacy Officer. These policies and practices are designed to match the scope and complexity of our various business activities. The following subsections provide detailed information, in simple and clear terms, to inform you about our governance policies and practices regarding personal information.

 

Data lifecycle management. Our policies cover the entire lifecycle of your personal information. We retain your personal information only as long as necessary to fulfill the purposes for which it was initially collected, unless legal obligations require us to retain it longer, such as laws governing the practice of law and tax laws. Once personal information has served its purpose, we ensure its secure and responsible destruction or anonymization, following strict guidelines.

Employee and service provider responsibilities. Within our organizational structure, roles and responsibilities regarding the processing and management of personal information are clearly defined for our employees. All employees undergo training in this regard and are held accountable for any non-compliance with our personal information protection standards. Regarding service providers, we establish contractual relationships exclusively with entities that commit to adhering to industry-standard security measures and to complying with the law. These agreements have been carefully reviewed to ensure that they comply with applicable laws and the principles set out in our policy.

Security and compliance assessments. To ensure ongoing compliance with our policies and practices, we conduct periodic internal assessments. These assessments focus on how personal information is collected, stored, processed, and deleted, and involve a thorough review of our processes and procedures. The assessments help determine the effectiveness of our existing security measures and propose continuous improvements.

Complaint handling. In accordance with our commitment to personal information protection, we have established a formal process to receive, investigate, and resolve any complaints regarding the safeguarding of your personal information.

Security measures. To protect your personal information, we use a multi-level security approach that includes physical, electronic, and administrative measures to prevent unauthorized access, use, alteration, and disclosure of your personal information.

Although these policies and measures align with industry best practices, it is important to recognize that the absolute security of your personal information during online transmission or while using online services cannot be unconditionally guaranteed. Such transmissions are therefore at your own risk.

We strive to present our policy in a simple and easily understandable manner to ensure that you are fully informed about how we handle your personal information.

17. Retention, Destruction, and/or Anonymization of Information
Unless otherwise permitted or required by applicable law or regulation, we will retain your personal information only for as long as necessary to fulfill the purposes for which we collected it, including to satisfy any legal, accounting, or disclosure requirements. In certain circumstances, we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified information for any legitimate purpose without notifying you or seeking your consent.

It is important that the personal information we hold about you is accurate and up to date. Please keep us informed of any changes to your personal information. The law gives you the right to request access to the personal information we hold about you and the right to correct that information.

19. Changes to Our Policy
Privacy laws evolve rapidly and, as a result, our policy may be modified from time to time by the Organization, at its sole discretion, without notice or liability to you or any other person. The collection, use, and disclosure of your personal information by the Organization will be governed by the version of our policy in effect at that time. If we are authorized to contact you for this purpose, we reserve the right to notify you by email or any other communication method we are authorized to use, of any significant changes made to our policy. This communication will be made in addition to updating the "last modified" date displayed at the bottom of this page.

 

20. Complaint Regarding Compliance With Our Policy
The Organization will respond to complaints submitted by individuals or to questions regarding our compliance with our policy and applicable personal information protection laws. We will investigate and attempt to resolve all complaints. To challenge our compliance with this policy, please contact our Privacy Officer using the contact information provided above.

 

21. Language

In the event of a discrepancy between the French and English versions of this Privacy Policy, the French version shall prevail.
